Terms of Service

1. Acceptance and Scope of Services

By accessing or using any website, web application, software, application programming interface (API), or digital service owned or operated by Actualizing Technologies LLC ("Company," "we," "us," or "our")—including actualizing.tech, its subdomains, affiliated domains, and authentication portals (collectively, the "Platform" or "Services")—you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not access or use the Platform.

• Eligibility: The Platform is strictly intended for individuals who are at least 18 years of age. By accessing or creating an account on any of our Services, you represent and warrant that you are at least 18 years old.
• Service-Specific Terms: Certain applications, interactive tools, or dialogue modules hosted within our Services (including Actualizing™ and Actualizing Sim) feature domain-specific rules, personal practice guidelines, or operational disclaimers. By using those specific tools, you agree to comply with any associated provisions outlined herein.

2. Simulation & Dialogue Applications: Personal Use Disclaimers

The provisions in this Section 2 apply specifically to any conversational simulation, roleplay exercise, or interpersonal dialogue applications (including Actualizing™ and Actualizing Sim) hosted on the Platform.

• Personal Deliberate Practice Only: Simulation and dialogue tools are designed strictly for self-directed deliberate practice, personal skill exploration, and individual learning. The Platform is a self-study tool, not a professional service, credentialing program, or institutional curriculum.
• AI Fallibility, Errors, and Hallucinations: You acknowledge that synthetic personas, conversational debriefings, and scoring metrics are powered by automated artificial intelligence models. These systems are probabilistic and prone to inaccuracies, logical omissions, and hallucinations. Content and feedback generated by the Platform may be incorrect or incomplete and must not be relied upon as definitive, authoritative, or factual truth. You bear sole responsibility for critically evaluating any AI-generated content.
• No Emergency or Crisis Services: The Platform is an unmonitored, automated personal software environment. It does not provide crisis intervention, emergency communication, suicide prevention, or medical assistance. If you or someone you know is experiencing a mental health emergency, crisis, or physical danger, immediately contact emergency services (such as dialing 988 or 911 in the United States) or go to the nearest emergency department.
• Not Healthcare, Therapy, or Professional Advice: The Platform does not provide psychotherapy, medical treatment, mental health counseling, psychiatric care, healthcare diagnosis, or professional advice of any kind. Conversations and automated responses are synthetic simulations intended solely for individual study and self-reflection.
• No Professional Oversight or Licensure Credit: Automated metrics, turn-based feedback, and debriefing outputs generated by the Platform represent algorithmic system responses. They do not constitute human supervision, professional evaluation, certified assessment, or formal credit toward any state license, professional certification, or accredited degree requirement.
• Prohibition on Private and Confidential Information: The simulation and prompt input fields are designed solely for fictional or hypothetical scenarios. You agree never to enter sensitive personal data, private medical records, financial details, government identification numbers, confidential personal journals, or the Personally Identifiable Information (PII) of any real-world individual into any chat prompt, dialogue box, or audio input on the Platform.

3. Acceptable Use and System Integrity

Across all Services provided by Actualizing Technologies LLC, you agree to use the systems lawfully, responsibly, and for their intended personal purposes. You agree that you will not:

• Zero-Tolerance Harmful Content: You agree not to input, simulate, or generate content involving child sexual abuse material (CSAM), child sexual exploitation, the sexualization of minors, non-consensual sexual acts, graphic extreme violence, self-harm instructions, or facilitation of illegal activities. Violations will result in immediate termination of access and may be reported to law enforcement where required by law.
• Input, upload, or transmit real-world confidential information, trade secrets, personal health data, or private personal data belonging to yourself or any third party.
• Attempt to reverse-engineer, decompile, extract, prompt-inject, jailbreak, or circumvent the underlying multi-agent architecture, system instructions, or scoring algorithms across any application or API.
• Input or generate abusive, defamatory, harassing, sexually explicit, hateful, or unlawful content through dialogue fields or synthetic endpoints.
• Misrepresent automated, machine-generated feedback or personal practice hours as certified professional assessments, institutional endorsements, or accredited evaluations.
• Interfere with, overburden, or compromise the integrity, security, or performance of our infrastructure, servers, or connected systems.

4. Intellectual Property Rights

All software, multi-agent orchestration architecture, scenario prompts, evaluation criteria, user interface designs, proprietary algorithms, and branding—including Actualizing Technologies LLC, Actualizing™, the Actualizing logo, and all associated product identifiers (including Actualizing Sim)—are the exclusive intellectual property of Actualizing Technologies LLC. You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Platform solely for personal, non-commercial educational and self-practice purposes.

5. User Inputs and Platform Outputs

• Your Inputs: You retain ownership of the original text, audio, and conversational prompts you submit to the Platform ("Inputs"). Because the simulation operates on a stateless, real-time basis, the Platform does not persistently store your session transcripts or prompt history. You grant Actualizing Technologies LLC a worldwide, non-exclusive, royalty-free license to transmit, process, and execute inference on your Inputs solely for the duration of your active session to generate synthetic persona responses and immediate feedback metrics.
• Platform Outputs: All system responses, synthetic personas, evaluative scoring, automated feedback metrics, and scenario mechanics ("Outputs") are generated by our proprietary systems and models. Subject to your compliance with these Terms, we grant you a personal, non-exclusive, revocable license to view and review these Outputs solely for your individual self-study and deliberate practice.

6. Limitation of Liability and "As-Is" Disclaimer

The Platform and all hosted applications are provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. Actualizing Technologies LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall Actualizing Technologies LLC, its officers, members, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of data, personal decisions, professional or academic disputes, or reliance upon any AI-generated outputs, hallucinations, errors, or automated feedback—arising out of your use of or inability to use any Service hosted on the Platform.

7. Termination and Suspension

We reserve the right to suspend, disable, or terminate your access to the Platform or any hosted Service immediately and without prior notice if you violate these Terms, engage in abusive or unauthorized behavior, or compromise the security and stability of our systems.

8. Governing Law and Severability

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

9. Modifications to Terms and Services

We reserve the right to modify or update these Terms of Service or any hosted application at any time. Changes become effective immediately upon posting to actualizing.tech/terms. Your continued access to or use of any Service following posted revisions constitutes acceptance of the updated Terms.
